Store Regulations
I. Definitions
The terms used in these Regulations shall have the following meanings:

Customer – A natural person, legal person, or organizational unit without legal personality but granted legal capacity by special provisions, who places an Order in the Store.

Consumer – A natural person entering into a legal transaction with an entrepreneur, not directly related to their business or professional activity, as defined in Article 22(1) of the Civil Code.

Civil Code – The Act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended).

Regulations – These terms and conditions govern the sale of Goods and provision of electronic services via the online store at www.pearlani.com.

Online Store (Store) – The e-commerce platform available at Pearlani, enabling Customers to place Orders.

Goods – Brand-new products displayed in the Online Store.

Sales Agreement – A contract for the sale of Goods, concluded between Pearlani and the Customer via the Online Store.

Consumer Rights Act – The Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827).

Act on Electronic Services – The Act of 18 July 2002 on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended).

Order – A Customer’s declaration of intent to conclude a Sales Agreement, specifying the type and quantity of Goods.
II. General Provisions

These Regulations govern the use of the Online Store at Pearlani.

They constitute the regulations referred to in Article 8 of the Act on Electronic Services.

The Online Store is operated by AVARTEN EUROPE BV Limited Liability Company, a branch in Poland, with its registered office in Warsaw at ul. Cybernetyki 19B, 02677 Warsaw, NIP 5263600970, REGON: 523465694, entered into the Register of Enterprises of the National Court Register, maintained by the District Court for the Capital City of Warsaw in Warsaw, XIII Commercial Division of the National Court Register under KRS number: 0000996253.

These Regulations specify:
- Conditions for placing orders electronically.
- Principles for concluding Sales Agreements.

Customers must ensure their IT systems meet the minimum technical requirements to use the Store.

Access to the Store requires a computer or terminal device with internet access.

Pearlani reserves the right to restrict services to individuals over 18 years of age, with prior notification.

Customers may access, download, and print these Regulations at any time via the link on the Store’s homepage.
III. Rules for Using the Online Store
Orders may be placed without registration, provided the Customer accepts these Regulations. Pearlani implements technical and organizational measures to secure data transmission and prevent unauthorized access.
Customers are obligated to:
- Use the Store in compliance with Polish law, these Regulations, and general internet usage principles.
- Refrain from transmitting prohibited content (e.g., promoting violence, defamation, or violating third-party rights)
- Avoid disrupting the Store’s functionality through software or devices.
- Do not send unsolicited commercial information (spam).
- Use the Store in a manner that is not burdensome to others or Pearlani.
- Use Store content solely for personal purposes.
IV. Procedure for Concluding a Sales Agreement
- To conclude a Sales Agreement:

- Select Goods and add them to the basket.
- Modify Order details before final confirmation.
- Review the Order summary, including Goods description, total price, and additional costs.
- Accept the Regulations, provide mandatory personal data, and confirm the Order.
- The Agreement is concluded upon receipt of the Order in Pearlani’s system, confirmed via email.

Agreements are concluded in Polish or English, consistent with these Regulations.

Customers may access, download, and print the Regulations at any time.
V. Delivery

Delivery is available within the European Union, MENA, and worldwide.

Goods are delivered via courier services selected during checkout. Personal collection is unavailable.

Delivery costs and timelines are specified during the Order process.

Pearlani bears the risk of damage or loss during transport. Customers must report damages to the carrier and Pearlani promptly.

Standard delivery time is 3 business days.
VI. Prices and Payment Methods
Prices are displayed in Euro, inclusive of VAT, customs duties, and other charges.

VII. Complaints About Goods
Consumers are entitled to defect-free Goods under statutory warranty provisions (Civil Code, Articles 556-556[3]).
Complaints may be submitted:

- Through the Store’s contact form.
Pearlani will respond within 14 days of receiving the complaint.
VIII. Additional Guarantees
Pearlani provides additional guarantees for certain Goods, as specified in the attached guarantee card. These guarantees do not limit statutory warranty rights.
IX. Extrajudicial Dispute Resolution
Consumers may use out-of-court dispute resolution methods, including:

Filing a complaint with the Trade Inspection.

Submitting a dispute to a permanent arbitration court.

X. Final Provisions
Disputes with Consumers are resolved by courts with jurisdiction under the Polish Code of Civil Procedure.
Disputes with non-Consumers are resolved by courts with jurisdiction over Pearlani’s registered office.
Unregulated matters are governed by Polish law, including the Civil Code and Consumer Rights Act.
